Important terms governing your use of the Smitty Insurance website and its insurance and benefits information.
Effective Date: September 8, 2026 | Last Updated: September 8, 2026
Using this website or submitting its contact form does not create insurance coverage, bind a policy, submit an application, complete enrollment, or create an advisor-client relationship. Coverage becomes effective only when confirmed by the applicable carrier or plan and all required conditions have been satisfied.
1. Acceptance of These Terms
These Terms & Conditions (“Terms”) govern your access to and use of smittyinsurance.com (the “Site”), operated by Smitty Insurance LLC (“Smitty Insurance,” “we,” “us,” or “our”). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.
Separate agreements, carrier documents, plan documents, applications, authorizations, disclosures, or terms may apply to a consultation, quote, insurance application, enrollment, policy, benefits-administration service, or other transaction. If a separate written agreement conflicts with these Terms, the separate agreement controls for that transaction.
2. Eligibility to Use the Site
The Site is intended for users who are at least 18 years old or who use it with the involvement and permission of a parent or legal guardian. By submitting information, you represent that the information is yours to provide, is accurate to the best of your knowledge, and does not violate another person’s rights.
3. Informational Purpose; No Professional Advice
The Site provides general information about insurance, employee benefits, benefits administration, and potential next steps. Website content is educational and informational only. It is not a complete description of any insurance policy, health plan, benefit, exclusion, limitation, network, formulary, tax rule, legal requirement, or enrollment condition.
Nothing on the Site is legal, tax, accounting, medical, investment, or financial advice. You should consult an appropriately qualified professional about those matters. Do not delay seeking medical care or make a health decision based on Site content.
4. No Insurance Contract, Application, or Enrollment
Using the Site, submitting the contact form, sending an email, leaving a voicemail, or speaking in an initial consultation does not:
- Bind, issue, renew, change, replace, or cancel insurance coverage;
- Submit or complete an insurance or Marketplace application;
- Enroll you, your dependents, employees, or organization in any policy or plan;
- Guarantee eligibility, approval, pricing, savings, benefits, claims payment, effective dates, or any other outcome; or
- Create a fiduciary, legal, tax, medical, or other professional relationship.
Coverage and benefits are governed solely by the official application, policy, certificate, evidence of coverage, summary of benefits, carrier or plan documents, and applicable law. If Site content differs from an official document, the official document controls. Do not cancel or allow existing coverage to lapse until replacement coverage has been formally confirmed effective by the responsible carrier or plan.
5. Licensing, Eligibility, and Product Availability
Insurance products and services are offered only in jurisdictions where Smitty Insurance and the relevant producer are licensed or otherwise authorized. The Site is not a solicitation in a jurisdiction where the activity would be unlawful.
Availability, eligibility, underwriting, rates, subsidies, tax-credit eligibility, networks, formularies, contributions, participation requirements, benefits, limitations, and effective dates vary by state, county, ZIP code, carrier, plan, employer, household, and individual circumstances. They may change without notice. A carrier, plan, Marketplace, government agency, or other responsible entity—not Smitty Insurance—makes final eligibility, underwriting, enrollment, coverage, billing, and claims determinations within its authority.
6. Medicare Information
Smitty Insurance is an independent insurance agency. It is not connected with or endorsed by the United States government or the federal Medicare program, and this Site is not Medicare.gov.
Smitty Insurance may not represent every insurance organization or offer every Medicare plan available in your area. Plan availability and contract status may change. For information about all available options, visit Medicare.gov, call 1-800-MEDICARE (1-800-633-4227), or contact your State Health Insurance Assistance Program (SHIP).
Submitting a request does not enroll you in Medicare coverage, change existing benefits, or affect your current Medicare status. Any plan discussion, permission to contact, scope of appointment, application, and enrollment must follow then-current legal, regulatory, carrier, and plan requirements.
7. Contact Requests and Communications
When you submit the contact form, you ask Smitty Insurance to follow up about your inquiry using the email address or telephone number you provide. This request does not constitute consent to automated or prerecorded marketing calls or marketing text messages. Any legally required consent for a different method or purpose will be requested separately.
You are responsible for providing accurate contact information and for promptly updating us if it changes. Email and ordinary web forms are not guaranteed to be secure. Do not submit Social Security, Medicare or Medicaid, insurance member, financial account, medical-record, or employee-census information through the public form.
8. Privacy
Our Privacy Policy explains how we collect, use, disclose, and protect information associated with the Site. By using the Site, you acknowledge that you have had an opportunity to review that policy. Additional privacy notices or authorizations may apply to insurance, financial, health, employer, or benefits information collected later through a separate process.
9. Third-Party Websites and Resources
The Site may link to social-media platforms, maps, insurance carriers, plans, Marketplaces, government resources, or other third-party websites. Links are provided for convenience and do not mean that Smitty Insurance controls, guarantees, or endorses all third-party content, services, privacy practices, security, availability, or accuracy. Your use of a third-party service is governed by that party’s terms and policies.
10. Intellectual Property
The Site and its original text, design, branding, logos, graphics, photographs, layout, and other content are owned by or licensed to Smitty Insurance and are protected by applicable intellectual-property laws. Subject to these Terms, Smitty Insurance grants you a limited, revocable, non-exclusive, non-transferable license to view and use the Site for your personal or internal business informational purposes.
You may not copy, reproduce, republish, sell, license, modify, distribute, publicly display, scrape, or create derivative works from protected Site content without prior written permission, except as permitted by law. Third-party names, logos, and marks remain the property of their respective owners.
11. Acceptable Use
You agree not to:
- Use the Site for an unlawful, fraudulent, misleading, abusive, or harmful purpose;
- Submit information you are not authorized to provide;
- Attempt to gain unauthorized access to the Site, server, forms, accounts, or systems;
- Introduce malware, malicious code, automated spam, or disruptive traffic;
- Interfere with Site operation, security, or another user’s access;
- Impersonate another person or misrepresent your identity or authority; or
- Use automated means to extract Site content in a manner that violates applicable law or these Terms.
12. Disclaimers
To the fullest extent permitted by law, the Site and its content are provided on an “as is” and “as available” basis. Smitty Insurance disclaims all warranties, express or implied, relating to the Site, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and uninterrupted or error-free operation.
We make reasonable efforts to provide useful information, but we do not warrant that every statement is complete, current, or applicable to your circumstances. Insurance rules, plan terms, provider networks, formularies, premiums, benefits, and enrollment periods can change. Current official documents and information from the responsible carrier, plan, Marketplace, government agency, or administrator control.
13. Limitation of Liability
To the fullest extent permitted by law, Smitty Insurance and its owners, employees, representatives, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, business opportunity, goodwill, or anticipated savings, arising from or related to your use of or inability to use the Site, reliance on Site content, or use of a third-party link.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited. Some jurisdictions do not allow certain exclusions, so portions of this section may not apply to you.
14. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Smitty Insurance and its owners, employees, and representatives from claims, losses, liabilities, and reasonable costs arising from your unlawful misuse of the Site, your material violation of these Terms, or information you submit without authorization. This section does not require you to indemnify a party for that party’s own unlawful conduct.
15. Changes to the Site or These Terms
We may change, suspend, or discontinue all or part of the Site and may update these Terms from time to time. The “Last Updated” date identifies the current version. Changes apply prospectively when posted unless a different date is stated. Your continued use of the Site after an update constitutes acceptance of the revised Terms.
16. Governing Law
These Terms are governed by the laws of the State of New Hampshire, without regard to conflict-of-law principles, except to the extent federal law or another jurisdiction’s mandatory law applies. Any legal proceeding relating solely to the Site or these Terms must be brought in a court of competent jurisdiction in New Hampshire, unless applicable law requires otherwise.
17. Miscellaneous
If a provision of these Terms is held unenforceable, it will be modified only to the minimum extent necessary, and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign your rights under these Terms without our prior written consent. Headings are for convenience only.
